FRISCO, Pennsylvania — A third family has taken legal action against a Frisco daycare, alleging their 3-year-old daughter was physically mistreated by a caregiver inside the classroom while management failed to intervene after learning about the incidents. The latest lawsuit adds to a growing list of legal claims involving Kids ‘R’ Kids of Lawler Farm and its handling of children in a classroom during 2024.
The lawsuit, filed this week in Collin County by the Dallas-based Button Law Firm, follows two earlier lawsuits filed in March and May that accused caregivers of using inappropriate physical force and prohibited disciplinary practices with young children.
Third family joins growing legal battle
According to the newly filed complaint, the girl’s mother was not only a parent but also previously worked as the daycare’s curriculum coordinator, making her the first plaintiff who had both professional and personal ties to the facility.
Attorney Russell Button said every family that has stepped forward has added new details about what allegedly occurred inside the classroom.
According to Button, each new account has provided additional insight into what families claim was happening behind closed doors, contributing to what he described as a broader pattern of misconduct.
Surveillance video central to new allegations
The lawsuit alleges surveillance footage captured a caregiver yanking the child by the arm, forcing her into a chair, and yelling at her after the girl approached the teacher because her pencil was too sharp.
Button said the footage appears to show the caregiver shoving the child into a chair and forcing her to remain seated, describing the incident while reviewing the video.
The complaint further alleges the child’s mother later viewed the surveillance footage herself and immediately reported what she believed was abuse to the daycare’s owners.
Mother says she contacted state after no action
According to a statement shared by attorneys representing the family, the mother said she was shocked after watching the footage.
She stated that she reported the incident directly to the daycare owners, but after seeing no action taken, she contacted the state to report the allegations.
The lawsuit claims the child suffered physical, emotional, and psychological injuries as a result of the alleged incident.
It also alleges that an investigation by the Texas Department of Family and Protective Services uncovered multiple surveillance videos showing alleged misconduct involving children in the classroom and resulted in the daycare being cited for several violations.
No criminal charges filed as civil cases continue
While the civil lawsuits continue, the Frisco Police Department told WFAA that no criminal charges have been filed in connection with the allegations.
Button said the absence of criminal charges should not be interpreted as meaning the allegations are insignificant, maintaining that the claims remain serious and deserving of legal review.
The two previously filed lawsuits similarly accuse caregivers of pulling, yanking, shoving, striking children, and using excessive force, while also alleging daycare management failed to respond appropriately after learning about the reported incidents.
The latest lawsuit remains pending in civil court, and no court has determined liability or made findings regarding the allegations. Button said he believes additional families may still come forward as the legal process continues.
