Gilbert, Arizona — An Arizona couple could face felony child abuse charges after police say their 18-month-old son nearly drowned during a Super Bowl party while they were allegedly distracted and under the influence of marijuana. The case has drawn national attention after the toddler, who was declared dead at a hospital, was later found alive in the morgue.
According to investigators, the Maricopa County Attorney’s Office is reviewing the case to determine whether formal charges should be filed against the parents of Vincent Fiordilino following the February incident.
Police Say Toddler Was Found Face Down in Backyard Pool
Authorities said Vincent was discovered floating face down in a backyard swimming pool during a Super Bowl gathering.
A police report alleges that both parents admitted to smoking marijuana during the party and acknowledged they were not closely watching their son.
Investigators believe the child was able to enter the pool unnoticed because both parents’ judgment may have been impaired by marijuana and/or other mind-altering substances.
Emergency responders rushed Vincent to a nearby hospital, where doctors attempted to save his life.
Child Pronounced Dead Before Shocking Discovery
Police said a doctor later declared Vincent dead after lifesaving efforts were unsuccessful. According to investigators, the toddler was transferred to the hospital morgue at approximately 7:23 p.m.
However, several hours later, at around 11:52 p.m., members of the medical examiner’s team reportedly discovered the child was still alive and breathing.
The extraordinary discovery prompted an immediate emergency response, and Vincent was airlifted to Phoenix Children’s Hospital for further treatment.
The family’s GoFundMe described the emotional moment.
“Vincent was declared deceased. His devastated parents were sent home in unimaginable grief. But God had other plans.”
Police Report Raises Questions About Hospital Response
The police report also details concerns raised by officers and the child’s parents while Vincent was still in the hospital. According to investigators, a nurse reportedly told the doctor, “I have a pulse,” after signs of life were detected.
The report further alleges that when an officer informed the physician about the concern, the doctor insisted he had already made the medical determination.
Police also stated that officers and Vincent’s parents believed the toddler appeared to be breathing and taking occasional gasps of air. Hospital staff reportedly described those movements as agonal breathing, an involuntary reflex that can occur in critically ill patients.
Authorities have said the doctor will not face criminal charges in connection with the case.
Toddler Continues Recovery as Investigation Moves Forward
After arriving at Phoenix Children’s Hospital, Vincent remained in critical condition as several of his organs struggled to function properly.
According to the family’s fundraiser, doctors initially feared the child had suffered significant brain damage. However, additional testing later showed no evidence of permanent brain injury, offering the family hope for his recovery.
Although Vincent survived, his family says he will continue to require extensive therapy, ongoing medical monitoring, and treatment as he heals.
Meanwhile, prosecutors are reviewing the police investigation to determine whether Vincent’s parents will formally face felony child abuse charges related to the incident.
The case has raised difficult questions about child supervision around backyard pools, as well as hospital procedures following life-threatening medical emergencies.
