Oak Brook, Illinois — A Marine Corps veteran and retired Illinois firefighter who went out to celebrate with his family is now facing a devastating medical future after allegedly becoming critically ill following a meal of raw oysters. Joe Belgio, 44, has reportedly suffered permanent brain damage and spent months in a coma, according to a lawsuit filed against the restaurant and seafood suppliers.
The lawsuit alleges that contaminated oysters served at Gibsons Steakhouse & Bar in Oak Brook, roughly 15 miles west of downtown Chicago, caused the illness that ultimately left Belgio requiring full-time care.
Family Celebration Turned Into Medical Emergency
Belgio was reportedly dining with his family on June 30, 2025, when he ate raw oysters at the restaurant.
His fiancée, Melanie Stayer, said the family had been celebrating together during what should have been an ordinary and happy occasion. At the time, the couple had recently welcomed their five-month-old daughter, Carmela.
But just three days after eating the oysters, Belgio reportedly suffered a catastrophic medical emergency.
According to his attorney, Scott O’Sullivan, Belgio went into cardiac arrest and lost consciousness and oxygen for at least eight minutes.
Retired Firefighter Rescued by His Former Department
Belgio’s collapse led to an especially emotional rescue.
He was reportedly revived by the Cicero Fire Department, the same department where he had previously served as a firefighter. From there, he was rushed to a hospital for emergency treatment.
Doctors later tested Belgio for bacterial infections, and his legal team says multiple pathogens were identified in his system. The lawsuit alleges that he contracted Enteropathogenic E. coli (EPEC) and Plesiomonas shigelloides after consuming the oysters.
The allegations have not been proven in court.
Months in a Coma Left Him Permanently Brain Damaged
Belgio’s condition deteriorated so severely that he spent months in a coma. He has since remained hospitalized and is reportedly confined to a hospital bed, requiring round-the-clock medical assistance.

His attorney described the long-term consequences as devastating, saying Belgio has very little cognitive capacity and is likely to remain bedridden for the rest of his life.
The family now faces not only the emotional consequences of his condition but also enormous medical expenses. According to the family’s fundraising campaign, Belgio has already accumulated more than $1 million in medical bills.
Steakhouse Denies Causing Belgio’s Illness
Gibsons has rejected the allegations that its food caused Belgio’s condition. In a statement, the restaurant said there had been no other reported cases of illness associated with the incident.
The steakhouse also said its own investigation found no evidence that the establishment caused Belgio’s health condition, adding that it expects the legal process to support its position.
Two seafood suppliers, Supreme Lobster and Seafood Company, have also been named as defendants in the lawsuit.
The case will ultimately have to determine whether the oysters were contaminated and, if so, whether the contamination was responsible for Belgio’s catastrophic illness.
Family Appeals for Help as Costs Continue
Belgio’s family has also turned to the public for financial support.
A GoFundMe campaign describes him as a devoted father, Little League coach, former Marine and firefighter who dedicated much of his life to serving others.
The fundraiser says Belgio completed a tour of duty in Iraq and was known for helping people whenever they needed assistance.
Since being launched on July 8, 2025, the fundraiser has reportedly collected more than $85,000 toward his medical and family expenses.
For Stayer and their young daughter, the situation represents an unimaginable change from the family celebration they expected to remember.
