Marion County, Florida — A Florida father is facing a first-degree felony murder charge after prosecutors allege a prank involving a leaf blower led to the death of his 6-month-old son, a case that has shocked the local community and is now headed toward trial.
Authorities say the child was hospitalized in critical condition before later dying, prompting an extensive investigation into the circumstances surrounding his injuries.
Father Indicted on Murder Charge
According to court records filed by prosecutors on July 30, James Westervelt III, 38, was formally indicted on one count of first-degree felony murder.
The indictment also states that additional charges are pending, although prosecutors have not yet announced what those charges may be.
The case stems from an incident that occurred in August 2024 at the family’s home in Marion County, located in North Central Florida.
Infant Hospitalized After Emergency Call
Authorities said deputies responded to the residence after receiving a report of an unresponsive 6-month-old infant. Emergency responders transported the baby to a hospital, where he was placed on life support.
Despite medical efforts, the child died several days later. Following the infant’s death, investigators launched a criminal investigation to determine what had happened inside the home.
Investigators Describe Alleged ‘Prank’
According to investigators, Westervelt allegedly admitted that he used a leaf blower on his infant son because he believed it was funny.
Authorities have not publicly detailed exactly how the leaf blower was used or whether prosecutors believe it directly caused the fatal injuries.
Investigators also reportedly recovered video evidence that allegedly showed Westervelt using the yard tool on the baby’s face when the child was even younger.
The existence of the video became part of the investigation as detectives reviewed evidence surrounding the infant’s death.
Medical Examiner Ruled Death Was Caused by Shaken Baby Syndrome
Officials determined that the infant died as a result of shaken baby syndrome, according to reports cited by investigators.
Prosecutors have not publicly explained how the alleged leaf blower incident and the medical findings will be presented together during court proceedings.
Those questions are expected to be addressed as the criminal case progresses.
Investigation Continues as More Charges Remain Possible
The Marion County Sheriff’s Office continues to investigate the case alongside prosecutors. Officials have indicated that additional criminal charges may still be filed beyond the murder indictment.
At this stage, prosecutors have not released further details regarding the pending charges or additional evidence expected to be introduced in court.
The Independent reported that it sought comment from prosecutors, the Marion County Sheriff’s Office, and an attorney representing Westervelt. Any responses had not been publicly reported at the time of publication.
