Durham, North Carolina — A teenage couple is facing felony charges after authorities say a 31-week premature baby boy was found alive in a toilet inside a Durham apartment last week. Investigators allege the child’s mother had taken abortion medication days before giving birth, while prosecutors say the case will be reviewed carefully under North Carolina law.
Police Say Newborn Was Found Alive in Apartment Toilet
According to the Durham Police Department, emergency responders were called to an apartment in the 2800 block of Ross Road on July 29 following a report involving a premature birth.
When paramedics arrived, they discovered a newborn baby boy inside a toilet. Authorities said the infant still had a pulse and was immediately transported to a hospital for emergency medical treatment.
Police also said the baby’s mother, 18-year-old Syeisha Johnson, was taken to the hospital.
Investigators later determined the child had been born at approximately 31 weeks of pregnancy.
Teen Mother and Boyfriend Face Criminal Charges
Following the investigation, Johnson was charged with assault with a deadly weapon with intent to kill, child abuse, and assault inflicting serious bodily injury on an unborn child.
Her boyfriend, 19-year-old Elijah Speight, has been charged with negligent child abuse. According to an arrest warrant, investigators allege Johnson learned in June that she was approximately 20 weeks pregnant.
Police claim she later ordered the abortion medication mifepristone online and took the medication several days before giving birth.

Case Raises Questions Under North Carolina Abortion Law
North Carolina law generally prohibits most abortions after 12 weeks of pregnancy, although certain exceptions exist, including cases involving rape, incest, or specific fetal conditions.
According to investigators, Johnson told authorities she did not realize she was pregnant until she was about 20 weeks along. The allegations contained in the arrest warrant have not been proven in court, and the criminal proceedings are still in the early stages.
District Attorney Says Evidence Will Be Carefully Reviewed
The investigation has been submitted to the Durham County District Attorney’s Office for review. District Attorney Satana Deberry told reporters that prosecutors would examine the facts carefully before moving forward.
She reiterated her previously stated support for a woman’s right to make decisions about her own body, while emphasizing that her office would evaluate the available evidence within the framework of the law.
Her comments highlighted the legal and factual complexities surrounding the case, which remains pending.
Court Appearance Scheduled Later This Month
Johnson and Speight were arrested and booked into the Durham County Jail before later being released after posting $1,000 bonds, according to authorities.
The couple is scheduled to appear in court on Aug. 26, where the charges will proceed through the judicial process.
Meanwhile, the newborn remains hospitalized and continues receiving medical care. Officials have not released additional information regarding the child’s current condition.
