Gilbert, Arizona — A newly released police report has raised troubling questions about the care provided to an 18-month-old toddler who was reportedly discovered alive in a hospital morgue hours after being pronounced dead following a near-drowning incident.
According to local reports, the child was taken to Dignity Health Mercy Gilbert Medical Center on February 8 after being found unresponsive in the family’s swimming pool. Medical staff initially believed the toddler had drowned, and a doctor declared the child dead at 6:20 p.m.
However, investigators say events that unfolded afterward have become the focus of intense scrutiny.
Signs of Life Allegedly Discovered in Hospital’s Cold Room
A newly obtained police report and body camera footage from the Gilbert Police Department reportedly show the child displaying signs of life after being transferred to the hospital’s morgue, also referred to as the “cold room.”
According to the report, the medical examiner was preparing to examine the toddler when the child appeared to show movement. Police documents also allege that a nurse alerted others after detecting a pulse.
Despite multiple people reportedly observing signs that the toddler was still alive, authorities say the child had already been officially pronounced dead.
One officer recalled hearing a nurse urgently say:
“I have a pulse.”
The report also states that several officers believed the child was showing clear indications of life and attempted to alert the attending physician.
Officer Claims Doctor Dismissed Concerns
According to the police report, one responding officer attempted to inform the doctor that medical staff believed they had detected a pulse.
The officer alleged that the concerns were dismissed.
“[The doctor] arrogantly told me he was the doctor, he has the medical degree, he went to medical school for a reason, and to let him do his thing,” an officer wrote in the report.
Moments later, officers reported observing additional signs that the toddler was alive.
“The release of air was audible and visible,” an officer wrote in the report, adding, “It also began to sound like [the child] was gasping for air.”
Medical staff then resumed treatment and conducted further testing to assess the child’s condition.
Child Survived but Reportedly Suffered Permanent Brain Damage
Subsequent medical evaluations, including an MRI, reportedly confirmed that the toddler had survived the near-drowning incident. However, the child is said to have suffered permanent brain damage as a result of the ordeal.
The child’s identity has not been publicly released, and few additional details about the family’s current situation have been made public.
The incident has drawn significant public attention and raised concerns about emergency medical protocols, particularly in cases involving drowning victims.

Hospital Says Review Was Conducted
In a statement provided to local media, Mercy Gilbert Medical Center described the incident as deeply tragic and said it immediately launched an internal review.
“This is a heartbreaking situation.”
The hospital added:
“We immediately conducted a thorough review of all aspects of the care provided to learn what happened and to make meaningful changes to strengthen our care. Out of respect for the patient’s privacy, we cannot discuss details. We continue to work with the family and their representative. Patient safety and exceptional care is our highest priority.”
According to reports, the physician involved has not been charged with any criminal offense, and no criminal charges have been filed in connection with the incident.
